1. Scope
These AI Supplementary Terms apply whenever you use any Wesend AI Features. They supplement, and do not replace, the Wesend Terms of Service, Privacy Policy and DPA.
If there is a conflict between these AI terms and the main Terms of Service in relation to AI Features, these AI terms control to the extent of that conflict.
2. Definitions

| Input | Prompts, instructions, examples, source text, files, metadata or other material submitted to an AI Feature. |
| Output | Any response, suggestion, classification, transformation, summary, translation or other material generated by an AI Feature. |
| AI Provider | A third-party provider of models, APIs, infrastructure or safety tooling used by Wesend to provide AI Features (e.g., OpenAI). |
| High-Risk Use | A use case in which errors could reasonably result in death, personal injury, unlawful discrimination, significant legal consequences or equivalent serious harm. |
3. Use of AI Features
Wesend may offer AI Features to help generate replies, summaries, flows, tags, campaign ideas, sentiment analysis, translations, reports and similar assistance.
You may use AI Features only in connection with lawful use of the Service and subject to any usage caps, fair-usage limits, model-specific restrictions or plan entitlements we publish.
4. Restrictions and prohibited uses
- You must not use AI Features for unlawful surveillance, unlawful profiling, solely automated decisions with legal or similarly significant effects where prohibited, or High-Risk Use without appropriate human review and safeguards.
- You must not input personal data or confidential information unless you have a lawful basis and a genuine need to use that data within the AI workflow.
- You must not use AI Features to create or distribute harmful, deceptive, infringing, harassing, discriminatory, fraudulent or platform-prohibited content.
- Platform Compliance: You must strictly comply with the developer policies and messaging rules of Connected Platforms (e.g., Meta/Instagram) when using AI Features to generate or automate responses. You must not falsely represent AI-generated communications as purely human where that would be misleading.
- You must not use AI Features to develop, benchmark or train competing models or services where such use would breach law, contract or technical restrictions.
5. Ownership, responsibility and human review
As between you and Wesend, your Input and Output are treated as your Customer Content, subject to the licences granted in the main Terms.
You are solely responsible for reviewing Output before publishing, sending, relying on or automating it. Output may be inaccurate, incomplete, stale, biased, inappropriate or non-unique (commonly known as "hallucinations"). You remain responsible for all decisions and actions taken based on AI-generated Output.
Wesend does not guarantee that Output is original, free from third-party rights, factually correct, compliant with law or fit for any particular purpose.
6. AI Providers and availability
Wesend may use one or more AI Providers and may change providers, models, safety settings, rate limits, regions or technical implementations from time to time.
We may suspend or limit an AI Feature without prior notice where reasonably necessary for safety, legal compliance, provider requirements, abuse prevention, cost control or service integrity.
7. Data handling, logging and model training
Wesend may log Inputs, Outputs, error states, token volumes, model names, safety events, reviewer actions and other usage metadata to provide, secure, troubleshoot, monitor, measure and improve the core Service, subject to our Privacy Policy and DPA.
No AI Model Training: Wesend strictly prohibits the use of Customer Content and Meta Platform Data for training AI models. We do not use your Inputs or Outputs to train, fine-tune, or improve our own AI foundational models. Wesend selects AI Providers that provide appropriate contractual data protection commitments. Currently, OpenAI is contractually restricted from using API Customer Content to train its models. Where supported by our agreements with the applicable AI Provider, Customer Content and Meta Platform Data are not used to train or improve third-party AI models.
8. Termination
If your access to the main Service ends, your access to AI Features ends at the same time unless we state otherwise.
Wesend may suspend or terminate access to AI Features separately from the rest of the Service if AI-related misuse, legal risk, platform policy violations (e.g., Meta enforcement) or provider restrictions justify doing so.
